GENERAL TERMS & CONDITIONS

PUBLIC TOURS

  1.  BOOKINGS
    1.1 In order to book your tour, the total price of the tour must be paid. No deposits and partial payments are possible.
    1.2 Confirmation for the tour will be emailed once payment has been made.
  2. FARES
    2.1 All fares are in Australia Dollars (AUD) and include the Australian Goods & Services Tax of 10% (GST).
    2.2 All fares are valid for departures 1st April 2023 – 31st March 2024.
    2.3 Any additional costs such as optional activities or entry fees may change in price as these are third party arrangements.
    2.4 Colourful Trips reserves the right to alter fares or impose surcharges due to unforeseen circumstances.
  3. CHILD POLICY
    Persons under the age of 18 years are not permitted to travel without prior written consent from Colourful Trips
  4. AMENDEMENT, CANCELLATION & REFUND POLICY 

    FLEXIBLE:
    Date &/or name change permitted up to 24 hours before departure = no fee
    Cancellation 24+ hours before departure time = 100% refund
    Less than 24 hours notification from tour departure time = non refundable & no credit provided
    Failure to travel = non-refundable

    SAVER:
    Date &/or name change permitted up to 24 hours before tour departure = $35 fee per person.
    Cancellation at any time = non-refundable
    Failure to travel = non-refundable”

  5.  TOUR OPERATIONS
    5.1 Changes to tour
    Colourful Trips reserves the right to change, cancel or postpone any tour in accordance with operating requirements or circumstances beyond its control.
    Should change or cancellation prove necessary we will give you reasonable notice thereof, in the circumstances, and where available, offer you a comparable alternative. If the change or cancellation is due to a majeure (i.e. circumstances like political unrest, war or threat of war, riots, civil strife, closure of airports or ports, industrial disputes, terrorist activity, natural and nuclear disasters, fire, epidemic or health risk, Acts of God, or other similar events beyond Colourful Trips control) we will endeavour to find an alternative equal in value reasonable expenses incurred by us in respect of your booking.
    Colourful Trips is not responsible for the costs of any other travel arrangements affected due to our cancellations or rescheduling of any tour departure.
    5.2 Brochures
    The information in our brochures is correct to the best of our knowledge at the time of print but we cannot guarantee that any item or amenity mentioned will be available as circumstances may change since any marketing or sales material is released.
    5.3 Weather conditions
    Under no circumstances can we be held responsible for adverse weather conditions, nor can any tour be cancelled or amended by you at any time on the basis of weather conditions.
    We reserve the right to alter the itinerary in the event of bad weather, to ensure customer safety is maintained.
    5.4 Risk
    5.4.1 Where the passenger occupies a bus seat fitted with a safety belt, neither the operator or service providers, agents or co-operating organisations shall be liable for any illness, injury or death or any loss or damages or claims whatsoever arising from any accident or incident, if the safety belt is not being worn at the time of the accident or incident.
    5.4.2 Some activities on the tour may pose risks and it is expected that passengers will exercise good care to minimise any risks.
    5.4.3 All passengers will be held liable for all costs incurred should they sustain any injuries or medical conditions whilst undertaking the tour.
    5.5 Animals
    Under no circumstances can we be held responsible for not seeing any animals on our tours. E.g. Whale or dolphin watching or kangaroos. As they are wild animals we cannot guarantee them being there at the time of the tour, nor can any tour be refunded on the basis of not seeing wild animals.
    5.6 Illness
    5.6.1 In the event of your withdrawal from a tour after the commencement as a result of illness, you must obtain a medical certificate in support of any travel insurance claim.
    5.6.2 No refunds will be made for any absence from the tour, once it has commenced.
    5.7 Smoking & Alcohol consumption
    5.7.1 Government regulations prohibit smoking and the drinking of alcohol inside tourist coaches within Australia.
    5.7.2 Smoking is restricted to appropriate comfort stop made en-route in the designated smoking areas.
    5.8 Special requirements 
    5.8.1 Colourful Trips must be advised at time of booking of any medical conditions, dietary requirements or physical disabilities requiring special attention. If you do not advise us at this stage, Colourful Trips cannot guarantee your requirements can be catered for.
    5.8.2 We will do our best to cater for your needs but we will not be held responsible if they cannot be fulfilled.
    5.9 Complaints
    5.9.1 Should you have a complaint in respect of the tour, you should inform the Colourful Trips staff immediately so that action be taken to resolve the matter.
    5.9.2 If the matter cannot be resolved during the tour, or if you wish to make a complaint following the conclusion of the tour, they should be made in writing to the Colourful Trips team as soon as reasonably possible but within 28 days of travel so it can be investigated.
    5.9.3 Any complaints made outside of the 28 day period, may not be considered by the Colourful Trips team and the ability to investigate the complaint may be prejudiced.
    5.10 Promotional material
    You agree that Colourful Trips may take photographs and films of you while on tour and that these may be used in our group brochures and/or advertising and publicity material without obtaining further consent or payment in respect of such photographs and/or films.

    6.    INSURANCE 
    Colourful Trips very strongly recommends that you take out comprehensive insurance cover for cancellation, medical expenses, personal accident, personal baggage, money and public liability before embarking on a Colourful Trips tour. Please check that the insurance covers all the activities that you are going to be participating in. Some policies exclude certain adventure activities. This should be arranged at the time of payment of the tour and will, in certain circumstances, cover you against loss of payment or cancellation fees from the date of confirmation of your booking, as shown in the insurance policy. You also agree to indemnify us against all third-party claims, actions, damages and remedies which may be brought against us in respect of your participation in the tour.

PRIVACY POLICY

Introduction

Colourful Trips Pty Ltd (From here on called CT) has adopted practices to protect your privacy so that you feel confident about how CT handles the personal information you entrust to CT online.

It is always advisable to double-check when you visit CT site to be sure that you have read and agree with the most current policy statement.  Any change(s) in CT privacy policy will be prospective only.  CT will not make any changes that have retroactive effect unless legally required to do so.

Collection
CT only collects personally identifiable data, such as names, addresses, e-mail addresses, demographic information (region/country from), interests, taste or preference information, and so forth, when voluntarily submitted by a visitor.  Visitors may choose to submit personal information to enter contests, to obtain information, submit a comment, ask a question, place a travel booking, join mailing lists, or contact CT in anyway.

Use of Information and Disclosure
Providing personal information is up to you. CT will collect personally identifiable information provided by you so we can e-mail you with updates and news, to respond to your questions or comments, to send out brochures and other information, to contact you of travel requests/bookings, or if you contacted CT.  CT ask visitors providing e-mail addresses to let CT know if they would not like CT to store or use their e-mail address in anyway.  CT offers anyone an “opt-out” option at any time they wish to cease receiving e-mails, other information from CT, or for CT to not store any of their information, as long as the law so allows it.  CT will never sell or give the information that you voluntarily provide CT to any third party.  It is used solely by CT agent(s), business partner(s), supplier(s), staff, and others who work within or without of the office for business reasons.

CT does ask that our business partners follow and uphold CT’s privacy statement. However, CT unfortunately can not extend this privacy policy to any of CT business relationships.  These companies include but are not limited to ones that (a) assist CT in providing services to CT customers; (b) supply CT with information for identifying or evaluating prospective customers; (c) assist in the daily operation of business, e.g. website development, accounting, etc; or (d) come into the office to conduct business.  If you wish for your information to be withheld from any of the CT business partners, please contact them directly.

Other Information CT Receives
Any information that you send CT via the phone, fax, mail, personal drop-off, or any other means possible, conforms to this privacy statement, and will only be used for CT use.  If you wish for CT to not use any information, please inform CT.

Links To and From Other Sites
When CT offers a link to another site, CT is not responsible for the content or information collection policies of that site.  CT also is not responsible for content or information collection policies of websites that direct you to the CT website.

Colourful Trips App

CT is only able to determine the number of downloads and in which country the app was downloaded. No information is collected and CT is unable to access any personal information.

Safeguards
CT has instituted safeguards to ensure that all information stored with CT is secure.  However CT is not responsible for any malfunctions that occur with any storage device.  CT is also not responsible for any stolen information that is taken from CT without CT knowledge.  CT takes security very seriously and never foresees any such event occurring.

Other Information
CT reserves the right to use or disclose any information as needed to satisfy any law, regulation or legal request, to protect the integrity of the site, to fulfil your requests, or to cooperate in any legal investigation.  Any part of this privacy policy that is unlawful is null and void.

Use and Agreement
By accessing CT site or any page of CT site, by any means, you accept this privacy statement.  If you do not agree with this privacy statement, CT asks that you to kindly leave the site.
